Club for Growth: FEC could “yes” or “no” on writing Specter donors
Once again, the FEC helps prove our point that even the simplest things in election law can be obscure and complicated by today publishing TWO draft opinions on the same question. Politico covers this, though not in any detail.
That would be the question, simply stated, “may we write Specter’s donors to tell them about his refund policy?”
The answer, I thought, was pretty clear, “yes.” However one never knows, and since Sen. Specter has been known to file frivolous complaints while showing a remarkableability to flout the law himself, we thought we should play it safe and ask the FEC for an advisory opinion first.
I commend the agency’s lawyers who wrote Draft A, which is a clear statement of the existing law, which would allow us to send the letter. It shows how our request is essentially identical to other similar requests made, and approved, in the past.
Draft B, which says “no you can’t” is absurd, a real misreading of the law.
I urge you to read both and see for yourself how absurd Draft B is and how complicated even the simplest things in election law have become.
Anyway, we should find out on Aug. 27 what the commissioners think. Let’s hope clear heads prevail at the Commission.
