The Board of County Commissioners today authorized a road improvement agreement with the city of Edgerton related to the construction of improvements to 191st Street. The improvements would accommodate the Intermodal Facility proposed by the Burlington Northern Santa Fe Railways (BNSF) and the Logistics Park which is being developed by The Allen Group. The project, with an estimated cost of $14 million, will improve 191st Street from Four Corners Road to 188th Street and Gardner Road. Funding for the project will be provided through the county’s share of funding from the Kansas Department of Transportation (KDOT). The county is “borrowing” ahead on fund allocations for future years with KDOT planning to “front” the money. The road improvements will be built to county infrastructure standards. The construction will start only if and when BNSF issues a notice to proceed with development of the intermodal facility. BNSF has until December 31, 2010, to make that notice or the county has the option to terminate its commitment for the 191st Street improvements. The intermodal project and the Logistics Park-Kansas City are being planned on approximately 1,000 acres purchased by BNSF at 191st Street between Waverly and Four Corners roads. In a separate related request, the Board approved an inter-local agreement for planning services on an interim basis to the city of Edgerton regarding the intermodal/warehouse complex. The services, including zoning code enforcement, will be provided to city staff by the county’s Department of Planning, Development, and Codes.

The Board authorized $2,517,000 in additional funding for the Douglas L. Smith Middle Basin Treatment Plant Solids Processing Improvements Project, increasing the total project authorization to $20,406,000, and approved a $2,241,402 change order with BRB Contractors, Inc. The project at the treatment plant in Overland Park is being funded from a $15.8 million low-interest loan through the American Reinvestment and Recovery Act (ARRA). The loan is being administered by the Kansas Department of Health and Environment (KDHE) through the Kansas Water Pollution Control Revolving Fund (KWPCRF). The Board awarded a $13,079,000 contract to BRB Contractors to do the work. The change order was requested because of additional labor costs associated with the ARRA and the KWPCRF. The costs represented the difference between the prevailing wage labor rates under the federal Davis-Bacon Wage Act and the contractor’s pay rates. The funding request also included $120,000 for additional engineering services. In a separate related request, the Board approved a $2,361,400 amendment to the KWPCRF loan agreement and increased the total loan amount to $18,161,400. The loan provides funding for the Douglas L. Smith Middle Basin Treatment Plant Solids Processing Improvements Project (approximately $15.4 million) and a System-wide Energy Efficiency Pre-Design Study (approximately $400,000) by Johnson County Wastewater. Both projects were selected to receive funding through the state’s revolving fund and ARRA.

The Board approved a memorandum of understanding with the Kansas City Area Transportation Authority regarding the level of federal funding assistance to Johnson County Transit for the provision of The JO, The JO - Special Edition, preventive maintenance, mobility management, and planning activities and for the existing grants and projects administrator position. In a separate related request, the Board authorized an FY 2010 Johnson County Transit Section 5307 grant of up to $1,650,000 from the Federal Transit Administration to be used for capital costs of contracting preventive maintenance, mobility management, and short- and long-range transportation planning and for the grants and projects administrator position. The grant required a local match of $412,000 to be funded from the FY 2010 Transit operating budget for a total project cost of $2,062,500.

The Board authorized $111,300 in construction phase funds for Site No. 2 sewer relocation, increased the total project authorization to $1,679,300, and approved an exception to competition for the project. The action included approval of an addendum to the agreement with the city of Overland Park regarding the U.S. 69 Highway/I-35/75th Street Sanitary Sewer Relocation Project. In a separate related request, the Board approved a $99,468 contract with Holthouse Construction L.L.C. to construct the Site No. 2 sewer relocation.

The Board authorized separate agreements with the cities of Edgerton and De Soto for the provision of law enforcement services in 2010 by the Sheriff’s Office. The cost for Edgerton will not exceed $259,877 plus up to $5,000 for certain overtime expenses. The agreement with De Soto totaled $432,087 plus up to $7,000 for certain overtime expenses.

The Board reappointed Mark Greene, Shawnee, as a Seventh District representative to the Transportation Council through December 11, 2012, and appointed Phil Perry, Mission, as a Third District representative to the Housing and Community Development Advisory Committee through April 1, 2012.

The Board also ratified the Chairman’s reappointment of Carol Whitlock, Merriam, as an unincorporated area representative to the Planning Commission through October 4, 2012.

Finally, in other action, the Board:

Renewed property, crime, professional liability, public official, commercial general and automobile liability, excess workers’ compensation, and Sheriff’s law enforcement policies for 2010 with the quoting carriers for $1,042,540;
Authorized a $107,550 contract with Museum Insight with Object Idea and Christopher Chadborne & Associates for museum interpretative planning services using Institute of Museum and Library Services grant funds at no cost to the county;
Granted a request from Phelps Engineering, Inc., applicant for Gerald and Dianna Smith, landowners, to rezone from Rural District to Planned Rural District and approval of preliminary and final development plan (plat) for two residential lots on 35 acres located at 18560 Lackman Road to be known as Wolf Creek Estates, Second Plat; and,
Approved the November 12, 2009, business session minutes.
